(أَنْ مُعْتِقَهُمَا كَانَ حِينَ الْعِتْقِ لَهُمَا غَيْرُ بَالِغٍ وَنَحْوَهُ) كَجُنُونِهِ. (أَوْ جَرَحَا شَاهِدَيْ حُرِّيَّتَهُمَا) فَلَا يُقْبَلُ مِنْهُمَا ذَلِكَ؛ لِعَوْدِهِمَا إلَى الرِّقِّ بِهِ.
