مطالب أولي النهىal-Ruhaybani

(وَلَوْ أَقَرَّتْ مُزَوَّجَةٌ بِوَلَدٍ لَحِقَهَا؛ لِإِقْرَارِهَا دُونَ زَوْجِهَا) لِعَدَمِ إقْرَارِهِ بِهِ، وَكَمَا لَوْ أَقَرَّ بِهِ رَجُلٌ؛ فَإِنَّهُ لَا يَلْحَقُ بِامْرَأَتِهِ دُونَ (أَهْلِهَا) هَذِهِ عِبَارَةُ " الرِّعَايَةِ " وَفِيهَا نَظَرٌ لِأَنَّهُ إذَا لَحِقَهَا نَسَبُهُ تَبِعَهَا أَهْلُهَا كَالرَّجُلِ وَهَذَا مُقْتَضَى كَلَامِ الْجُمْهُورِ.
