وَظَاهِرُهُ: وَلَوْ عَلَى مَالٍ حَتَّى يُصَالِحَ وَ (لَا) يُعْذَرُ بِتَرْكِهِمَا (مَنْ عَلَيْهِ حَدٌّ) لِلَّهِ تَعَالَى: كَحَدِّ الزِّنَى وَشُرْبِ الْخَمْرِ وَقَطْعِ السَّرِقَةِ؛ لِأَنَّ الْحُدُودَ لَا تَدْخُلُهَا الْمُصَالَحَةُ، بِخِلَافِ الْقِصَاصِ.
