فَإِنْ كَانَتْ عِنْدَهُ وَهِيَ أعْلَى مِنْ الْوَاجِبِ خُيِّرَ بَينَ إخرَاجِهَا وَشِرَاءِ مَا بِصِفَتِهِ.

مطالب أولي النهىal-Ruhaybani

(عِنْدَهُ وَهِيَ أَعْلَى مِنْ الْوَاجِبِ) عَلَيْهِ فِيمَا بِيَدِهِ، (خُيِّرَ بَيْنَ إخْرَاجِهَا وَ) بَيْنَ (شِرَاءِ مَا) ، أَيْ: بِنْتِ مَخَاضٍ (بِصِفَتِهِ) ، أَيْ: الْوَاجِبِ، وَيُخْرِجُهَا وَلَا يُجْزِيهِ ابْنُ لَبُونٍ إذَنْ، لِوُجُودِ بِنْتِ مَخَاضٍ صَحِيحَةٍ فِي مَالِهِ.
