(وَيُصَدَّقُ مَالِكٌ بِلَا يَمِينٍ فِيمَا سَقَى بِهِ مِنْهُمَا) ؛ لِأَنَّ النَّاسَ لَا يُسْتَحْلَفُونَ عَلَى صَدَقَاتِهِمْ؛ لِأَنَّهَا حَقٌّ لِلَّهِ، فَلَا يُسْتَحْلَفُ عَلَيْهَا كَالصَّلَاةِ وَالْحَدِّ.
