(إلَّا أَنْ يَدَّعِيَهُ) ، أَيْ: التَّلَفَ (بِ) سَبَبٍ (ظَاهِرٍ فَيُكَلَّفُ الْبَيِّنَةَ عَلَيْهِ) ، أَيْ: إنْ السَّبَبُ وُجِدَ، لِإِمْكَانِهِ (ثُمَّ يُصَدَّقُ فِيمَا تَلِفَ) مِنْ مَالِهِ بِذَلِكَ كَالْوَدِيعِ وَالْوَكِيلِ
