(وَلَا عُشْرَ عَلَيْهِمْ) ، أَيْ: أَهْلِ الذِّمَّةِ (فِيهَا) ، أَيْ: فِي الْأَرْضِ الْعُشْرِيَّةِ أَوْ الْخَرَاجِيَّةِ إذَا اشْتَرُوهُمَا أَوْ اسْتَأْجَرُوهُمَا وَنَحْوُهُ؛ لِأَنَّهُ زَكَاةٌ وَقُرْبَةٌ، وَلَيْسُوا مِنْ أَهْلِهَا
