(فَإِنْ لَمْ يَحْلِفْ وَنَفَاهُ وَاجِدُهُ فَ) هُوَ (لِمَنْ فَوْقَ) ، أَيْ: لِمَنْ قَبْلَهُ إنْ اعْتَرَفَ بِهِ، وَإِلَّا فَلِمَنْ قَبْلَهُ كَذَلِكَ إلَى أَوَّلِ مَالِكٍ اعْتَرَفَ بِهِ
