وَلَوْ نَوَى عَنْ غَائِبٍ وَلَم يَشتَرِط فَبَانَ تَالِفًا، لَم يَصْرِفهُ إلَى غَيرِهِ.

مطالب أولي النهىal-Ruhaybani

(وَلَوْ نَوَى عَنْ) مَالٍ (غَائِبٍ وَلَمْ يَشْتَرِطْ) ، أَيْ: لَمْ يَنْوِ إنْ كَانَ الْغَائِبُ تَالِفًا، فَعَنْ الْحَاضِرِ (فَبَانَ) الْغَائِبُ (تَالِفًا لَمْ يَصْرِفْهُ) ، أَيْ: الْمُخْرِجُ (إلَى غَيْرِهِ) ، لِأَنَّ النِّيَّةَ لَمْ تَتَنَاوَلْهُ، كَعِتْقٍ فِي كَفَّارَةٍ مُعَيَّنَةٍ، فَلَمْ تَكُنْ.
