(وَلَا) يَحْرُمُ (نَقْلُ نَذْرٍ) مُطْلَقٍ (وَكَفَّارَةٍ وَوَصِيَّةٍ مُطْلَقَةٍ) ، أَيْ: لَمْ يَخُصَّهَا مُوصٍ بِمَكَانٍ، لِأَنَّ الزَّكَاةَ مُوَاسَاةٌ رَاتِبَةٌ فِي الْمَالِ، فَكَانَتْ لِجِيرَانِهِ،

بِخِلَافِ الْمَذْكُورَاتِ، (لَا) إنْ كَانَتْ الْوَصِيَّةُ وَنَحْوُهَا (مُقَيَّدَةً بِ) فُقَرَاءِ مَكَانٍ (مُعَيَّنٍ) فَيَتَعَيَّنُوا لَهَا.
