(قَالَ الْقَاضِي) أَبُو يَعْلَى: (وَهُوَ) ، أَيْ: فِعْلُ الْإِمَامِ، (يَقْتَضِي جَوَازَ الْهَجْرِ بِأَخْذِ الشُّبْهَةِ) خِيفَةً مِنْ الْوُقُوعِ فِي الْمُحَرَّمِ.
