وَلَا يَخْتَصُ بِحَاكِمٍ، فَيَلْزَمُ الصَّوْمُ مَنْ سَمِعَ رُؤيَتَهُ مِنْ عَدْلٍ، وَلَوْ رَدَّهُ الْحَاكِمُ.

(وَلَا يَخْتَصُّ) ثُبُوتُهُ (بِحَاكِمٍ، فَيَلْزَمُ الصَّوْمُ مَنْ سَمِعَ رُؤْيَتَهُ مِنْ عَدْلٍ وَلَوْ رَدَّهُ الْحَاكِمُ) ، لِجَوَازِ أَنْ يَكُونَ لِعَدَمِ عِلْمِهِ بِحَالِ الْمُخْبِرِ، وَقَدْ يَجْهَلُ الْحَاكِمُ مَنْ يَعْلَمُ غَيْرُهُ عَدَالَتَهُ.
