لِمَنْ أُبِيحَ لَهُ فِطْرٌ بِرَمَضَانَ وَصَامَ، أَنْ يُفْطِرَ بِمَا شَاءَ مِنْ جِمَاعٍ وَغَيرِهِ، وَلَا كَفَّارَةَ.

مطالب أولي النهىal-Ruhaybani

[فَرْعٌ مَنْ أُبِيحَ لَهُ فِطْرٌ بِرَمَضَانَ] (فَرْعٌ: لِمَنْ أُبِيحَ لَهُ فِطْرٌ بِرَمَضَانَ) كَمَرِيضٍ وَنَحْوِهِ

(وَصَامَ، أَنْ يُفْطِرَ بِمَا شَاءَ مِنْ جِمَاعٍ وَغَيْرِهِ) كَأَكْلٍ وَشُرْبٍ، (وَلَا كَفَّارَةَ) عَلَيْهِ بِالْوَطْءِ لِحُصُولِ الْفِطْرِ بِالنِّيَّةِ قَبْلَ الْجِمَاعِ، فَيَقَعُ الْجِمَاعُ بَعْدَهُ.
