أَوْ أَكَلَ وَنَحْوَهُ شَاكًّا فِي طُلُوعِ فَجْرٍ

(أَوْ أَكَلَ وَنَحْوَهُ) كَمَا لَوْ شَرِبَ أَوْ جَامَعَ (شَاكًّا فِي طُلُوعِ فَجْرٍ) ثَانٍ، وَلَمْ يَتَبَيَّنْ طُلُوعَهُ إذْ ذَاكَ، لَمْ يُفْطِرْ؛ لِأَنَّ الْأَصْلَ بَقَاءُ اللَّيْلِ.
