(وَالنَّزْعُ جِمَاعٌ) ؛ لِأَنَّهُ يَتَلَذَّذُ بِهِ كَالْإِيلَاجِ، (فَيَلْزَمَانِ) ، أَيْ: الْقَضَاءُ وَالْكَفَّارَةُ (مَنْ نَزَعَ طُلُوعَ فَجْرٍ)

وَأَمَّا مَنْ حَلَفَ لَا يُجَامِعُ، فَنَزَعَ، فَلَا حِنْثَ؛ لِتَعَلُّقِ الْيَمِينِ بِالْمُسْتَقْبَلِ أَوَّلَ أَوْقَاتِ إمْكَانِهِ.
