مطالب أولي النهىal-Ruhaybani

(لَا) يَجُوزُ لِسَيِّدٍ وَزَوْجٍ تَحْلِيلُ قِنٍّ وَزَوْجَةٍ أَحْرَمَا (بِنَذْرٍ أُذِنَ) ، أَيْ: أَذِنَ (فِيهِ) زَوْجٌ وَسَيِّدٌ (لَهُمَا) ، أَيْ: الْقِنِّ وَالزَّوْجَةِ، لِأَنَّ الْإِذْنَ فِي نَذْرِهِ إذْنٌ فِي فِعْلِهِ، (أَوْ لَمْ يُؤْذَنْ فِيهِ) ، أَيْ: النَّذْرِ (لَهَا) ، أَيْ: الزَّوْجَةِ، فَلَا يُحَلِّلُهَا فِيهِ لِوُجُوبِهِ كَالْوَاجِبِ بِأَصْلِ الشَّرْعِ.
