(وَلَوْ أَخَذَهُ) ، أَيْ: الصَّيْدَ الضَّعِيفَ، مُحْرِمٌ (لِيُدَاوِيَهُ، فَوَدِيعَةٌ) عِنْدَهُ، (فَإِنْ فَرَّطَ) فِي حِفْظِهِ، أَوْ تَعَدَّى؛ (ضَمِنَ) ، وَإِلَّا فَلَا؛ لِأَنَّهُ مُحْسِنٌ.
