(وَلَا يُزَوِّجُ) الْمُحْرِمُ غَيْرَهُ (بِوِلَايَةٍ أَوْ) ، أَيْ: وَلَا (بِوَكَالَةٍ) ؛ لِحَدِيثِ ابْنِ عَبَّاسٍ «لَا يَنْكِحُ الْمُحْرِمُ، وَلَا يُنْكَحُ، وَلَا يَخْطُبُ عَلَى نَفْسِهِ، وَلَا عَلَى غَيْرِهِ» رَوَاهُ الشَّافِعِيُّ، وَرَفَعَهُ الدَّارَقُطْنِيّ
