فَإِنْ فَعَلَ فَقَد أَسَاءَ وَاسْتَغْفَرَ اللهَ وَلَا عَقلَ عَلَيهِ، وَلَا كَفَّارَةَ إذَا أُصِيبَ أَحَدٌ مِنْهُمْ بِطَاعَتِهِ.

مطالب أولي النهىal-Ruhaybani

(فَإِنْ فَعَلَ) أَيْ: حَمَلَهُمْ عَلَى مَهْلَكَةٍ أَوْ أَمَرَهُمْ بِدُخُولِ مَطْمُورَةٍ يُخَافُ أَنْ يُقْتَلُوا تَحْتَهَا (فَقَدْ أَسَاءَ وَاسْتَغْفَرَ اللَّهَ) وَتَابَ إلَيْهِ مِنْ ذَلِكَ، لِوُجُوبِ التَّوْبَةِ مِنْ كُلِّ مَعْصِيَةٍ، (وَلَا عَقْلَ) أَيْ: دِيَةَ (عَلَيْهِ، وَلَا كَفَّارَةَ إذَا أُصِيبَ أَحَدٌ مِنْهُمْ بِطَاعَتِهِ) لِأَنَّهُ فَعَلَ ذَلِكَ بِاخْتِيَارِهِ.
