(إلَّا إنْ تَعَيَّنَ) عَلَيْهِ الْجِهَادُ، لِحُضُورِ الصَّفِّ أَوْ حَصْرِ الْعَدُوِّ أَوْ اسْتِنْفَارِ الْإِمَامِ لَهُ (فَيَسْقُطُ إذْنُهُمَا كَإِذْنِ غَرِيمٍ) لِأَنَّهُ يَصِيرُ فَرْضَ عَيْنٍ، وَتَرْكُهُ مَعْصِيَةٌ.
