(وَحَرُمَ أَخْذُ مَالٍ) مِنْ الْكُفَّارِ (لِنَدْفَعَهُ) ، أَيْ: الرَّأْسَ (إلَيْهِمْ، لِأَنَّهُ مُعَاوَضَةٌ) عَلَى مَا لَيْسَ بِمَالٍ كَبَيْعِ الْكَلْبِ،
