(وَمَنْ أَسْلَمَ) مِنْ كُفَّارٍ (قَبْلَ أَسْرِهِ وَلَوْ) كَانَ إسْلَامُهُ (لِخَوْفٍ، فَكَمُسْلِمٍ أَصْلِيٍّ) ، لِعُمُومِ:«فَإِذَا قَالُوهَا عَصَمُوا مِنِّي دِمَاءَهُمْ» الْحَدِيثُ، وَلِأَنَّهُ لَمْ يَحْصُلْ بِأَيْدِي الْغَانِمِينَ،
