(وَيَتَّجِهُ: وَلَوْ) كَانَ الْآبِقُ (قِنًّا مُسْلِمًا) ، فَيَمْلِكُونَهُ، لِأَنَّهُ مَالٌ كَغَيْرِهِ مِنْ الْأَمْوَالِ، صَرَّحَ بِهِ فِي " الْقَوَاعِدِ "، وَهُوَ مُقْتَضَى مَا جَزَمَ بِهِ فِي " الْوَجِيزِ " وَتَذْكِرَةِ " ابْنِ عَقِيلٍ، وَقَدَّمَهُ فِي " الْفُرُوعِ " " وَالْمُحَرَّرِ " وَهُوَ مُتَّجِهٌ.
