(وَ) مِمَّا يَتَرَتَّبُ عَلَى مِلْكِهِمْ مَالَ الْمُسْلِمِ بِأَخْذِهِ أَنَّهُ (يَنْفَسِخُ بِهِ) ، أَيْ: بِاسْتِيلَاءِ أَهْلِ حَرْبٍ (نِكَاحُ أَمَةٍ) مُزَوَّجَةٍ اسْتَوْلُوا عَلَيْهَا وَحْدَهَا لِمِلْكِهِمْ رَقَبَتَهَا وَمَنَافِعَهَا، وَكَنِكَاحِ كَافِرَةٍ سُبِيَتْ وَحْدَهَا.
