وَإن هَذَا إذا كَانَتَا كَافِرَتَينِ، وإلا فَالْوَلَدُ مُسلِمٌ.

مطالب أولي النهىal-Ruhaybani

(إذَا كَانَتَا) ، أَيْ: الْحُرَّةُ وَأُمُّ الْوَلَدِ (كَافِرَتَيْنِ) ، لِأَنَّهُ مُتَوَلِّدٌ مِنْ كَافِرٍ وَكَافِرَةٍ، وَمَا دَامَا فِي الْحَيَاةِ فَهُوَ تَبَعٌ لَهُمَا، (إلَّا) بِأَنْ كَانَتَا مُسْلِمَتَيْنِ (فَالْوَلَدُ مُسْلِمٌ) تَبَعًا لِأُمِّهِ، فَلَا يُقِرُّ عَلَى الْكُفْرِ، وَهُوَ مُتَّجِهٌ.

[فَصْلٌ تُمْلَكُ غَنِيمَةٌ بِاسْتِيلَاءٍ عَلَيْهَا] (فَصْلٌ)
