(وَيُعَزَّرُ) الْغَالُّ بِضَرْبٍ وَنَحْوِهِ، لِأَنَّهُ فَعَلَ مُحَرَّمًا، (وَلَا يَنْبَغِي) لِعَدَمِ وُرُودِهِ، (وَيُؤْخَذُ مَا غَلَّ لِلْمَغْنَمِ) ، لِأَنَّهُ حَقٌّ لِلْغَانِمِينَ، فَتَعَيَّنَ رَدُّهُ إلَيْهِمْ.
