وَلَيسَ بِغَالٍّ من سَرَقَ مِنْ الغَنِيمَةِ، أو سَتَرَ عَلَى غَالٍّ، أو أَخَذَ مِنْهُ مَا أُهدِيَ لَهُ مِنهَا،

مطالب أولي النهىal-Ruhaybani

(وَلَيْسَ بِغَالٍّ مَنْ سَرَقَ مِنْ الْغَنِيمَةِ) ، لِعَدَمِ صِدْقِ حَدِّهِ عَلَيْهِ، (أَوْ سَتَرَ عَلَى غَالٍّ أَوْ أَخَذَ مِنْهُ) ، أَيْ: مِنْ الْغَالِّ (مَا أُهْدِيَ لَهُ مِنْهَا) ، أَيْ: مِمَّا غَلَّهُ مِنْهَا، أَوْ بَاعَهُ إمَامٌ أَوْ حَابَاهُ، وَلَا يُحْرَقُ رَحْلُهُ، لِأَنَّهُ لَيْسَ بِغَالٍّ.
