(وَيَضْمَنُ) ذِمِّيٌّ عَلَا بِنَاؤُهُ عَلَى بِنَاءِ جَارِهِ الْمُسْلِمِ (مَا تَلِفَ بِهِ) ، أَيْ: الْبِنَاءِ الْمُعَلَّى (قِبَلَهُ) ، أَيْ: النَّقْضُ لِتَعَدِّيهِ بِالتَّعْلِيَةِ، لِعَدَمِ إذْنِ الشَّرْعِ فِيهَا.
