مطالب أولي النهىal-Ruhaybani

(وَيُصَدَّقُ) كَافِرٌ تَاجِرٌ (أَنَّ جَارِيَةً مَعَهُ أَهْلُهُ) ، أَيْ: زَوْجَتُهُ، (أَوْ) أَنَّهَا (بِنْتُهُ، وَنَحْوَهُمَا) كَأُخْتِهِ لِتَعَذُّرِ إقَامَةِ الْبَيِّنَةِ عَلَى ذَلِكَ. وَالْأَصْلُ عَدَمُ مِلْكِهِ لَهَا، فَلَا تُعْشَرُ
