(وَلَا يَصِحُّ تَصَرُّفُ قِنٍّ فِي ذِمَّتِهِ) ؛ لِأَنَّهُ مَحْجُورٌ عَلَيْهِ،

وَكَذَا شِرَاءٌ بِعَيْنٍ مَا بِيَدِهِ مِنْ الْمَالِ بِغَيْرِ إذْنِ سَيِّدِهِ؛ لِأَنَّهُ فُضُولِيٌّ؛ (كَسَفِيهٍ) بِجَامِعِ الْحَجْرِ عَلَى كُلٍّ مِنْهُمَا.
