وَيَجُوزُ فِي فِكَاكِ مُسْلِمٍ ويُعْلِمُ كَافِرٌ بِنَجَاسَتِهِ،

مطالب أولي النهىal-Ruhaybani

(وَيَجُوزُ) دَفْعُ أَدْهَانٍ مُتَنَجِّسَةٍ لِكَافِرٍ (فِي فِكَاكِ) أَسِيرٍ (مُسْلِمٍ) ؛ تَخْلِيصًا لَهُ مِنْ الْأَسْرِ، وَهَذَا لَيْسَ بَيْعًا حَقِيقَةً، وَإِنَّمَا هُوَ افْتِدَاءٌ.

وَعَلَى دَافِعِ ذَلِكَ أَنْ (يُعْلِمَ الْكَافِرَ بِنَجَاسَتِهِ) ؛ أَيْ: الدُّهْنِ؛ لِيَكُونَ عَلَى بَصِيرَةٍ؛ فَلَا يَبِيعُهُ لِمُسْلِمٍ.
