مطالب أولي النهىal-Ruhaybani

(وَلَا) يَصِحُّ (بَيْعُ مَا) ؛ أَيْ: شَيْءٍ مُعَيَّنٍ (لَا يَمْلِكُهُ) الْبَائِعُ، وَلَا أُذِنَ لَهُ فِيهِ (كَحُرٍّ، وَمُبَاحٍ قَبْلَ حِيَازَتِهِ) ؛ لِحَدِيثِ حَكِيمِ بْنِ حِزَامٍ مَرْفُوعًا:«لَا تَبِعْ مَا لَيْسَ عِنْدَكَ» رَوَاهُ ابْنُ مَاجَهْ وَالتِّرْمِذِيُّ، وَصَحَّحَهُ.
