[فَرْعٌ بَيْعُ دَارٍ تَسْتَحِقُّ زَوْجَةٌ مُعْتَدَّةٌ سُكْنَاهَا] (فَرْعٌ) يَصِحُّ بَيْعُ دَارٍ تَسْتَحِقُّ زَوْجَةٌ

(مُعْتَدَّةٌ لِوَفَاةِ) زَوْجِهَا (سُكْنَاهَا) ؛ أَيْ: الدَّارِ، (وَهِيَ) ؛ أَيْ: الزَّوْجَةُ (حَامِلٌ) ؛ لِأَنَّ اسْتِحْقَاقَهَا لِمَنَافِعِ الدَّارِ، لَا تَمْنَعُ صِحَّةَ بَيْعِ عَيْنِهَا، كَالْمُؤَجَّرَةِ، (خِلَافًا لِلْمُوَفَّقِ) فَإِنَّهُ قَالَ بِعَدَمِ الصِّحَّةِ.
