(مَا وُصِفَ) لَهُ، (أَوْ تَقَدَّمَتْ رُؤْيَتُهُ) الْعَقْدَ بِزَمَنٍ (يَسِيرٍ) لَا يَتَغَيَّرُ فِيهِ الْمَبِيعُ تَغَيُّرًا ظَاهِرًا (مُتَغَيِّرًا فَلِمُشْتَرٍ الْفَسْخُ) ؛ لِأَنَّ ذَلِكَ بِمَنْزِلَةِ عَيْبِهِ، (وَيَحْلِفُ) مُشْتَرٍ (إنْ اخْتَلَفَا) فِي نَقْصِهِ صِفَةً، أَوْ تَغَيُّرِهِ عَمَّا كَانَ رَآهُ عَلَيْهِ؛ لِأَنَّ الْأَصْلَ بَرَاءَتُهُ مِنْ الثَّمَنِ، وَهُوَ عَلَى التَّرَاخِي؛
