(وَلَوْ أَسَرَّا ثَمَنًا بِلَا عَقْدٍ) ؛ بِأَنْ اتَّفَقَا عَلَى أَنَّ الثَّمَنَ عَشَرَةٌ، (ثُمَّ عَقَدَاهُ) ظَاهِرًا بِثَمَنٍ آخَرَ كَعِشْرِينَ؛ (فَالثَّمَنُ الْأَوَّلُ) ، وَهُوَ الْعَشَرَةُ؛ لِأَنَّ الْمُشْتَرِيَ إنَّمَا دَخَلَ عَلَيْهِ؛ فَلَا يَلْزَمُهُ مَا زَادَ.
