مطالب أولي النهىal-Ruhaybani

(وَلَا يَصِحُّ) بَيْعُ ثَوْبٍ (بِرَقْمٍ) وَهُوَ الْقَدْرُ الْمَكْتُوبُ عَلَيْهِ؛ لِلْجَهَالَةِ بِهِ حَالَ الْعَقْدِ، (وَلَا) بَيْعُ سِلْعَةٍ (بِمَا بَاعَ) بِهِ (زَيْدٌ) ؛ لِمَا تَقَدَّمَ، (إلَّا إنْ عَلِمَاهُمَا) ؛ أَيْ: عَلِمَ الْمُتَعَاقِدَانِ الرَّقْمَ، وَمَا بَاعَ بِهِ زَيْدٌ حَالَ الْعَقْدِ؛ فَيَصِحُّ.
