مطالب أولي النهىal-Ruhaybani

(وَلَا خِيَارَ بِحَمْلِ بَهِيمَةٍ) مَبِيعَةٍ (شُرِطَتْ) ؛ أَيْ: شَرَطَ مُشْتَرِيهَا عَلَى الْبَائِعِ كَوْنَهَا (حَائِلًا) ؛ لِأَنَّ الْحَمْلَ فِي الْبَهَائِمِ زِيَادَةُ تَنْفَعُ وَلَا تَضُرُّ، بِخِلَافِهِ فِي الْآدَمِيَّاتِ.
