وَلَوْ (بِلَا عُذْرٍ؛ جَازَ) ؛ لِجَوَازِ أَخْذِ الْعِوَضِ عَنْهَا مَعَ عَدَمِ الِاشْتِرَاطِ، فَكَذَا مَعَهُ، وَكَالْعَيْنِ الْمُؤَجَّرَةِ وَالْمُوصَى بِمَنَافِعِهَا.
