(وَ) إنْ قَالَ رَبُّ دَيْنٍ: (اقْضِنِي دَيْنِي عَلَى أَنْ أَبِيعَكَ كَذَا بِكَذَا) ، فَقَضَاهُ دَيْنَهُ؛ (صَحَّ قَضَاءٌ) ؛ لِأَنَّهُ أَقْبَضَهُ دَيْنَهُ (فَقَطْ) ؛ أَيْ: دُونَ بَيْعٍ مَشْرُوطٍ؛ لِأَنَّهُ مُعَلَّقٌ عَلَى الْقَضَاءِ، وَيَأْتِي أَنَّ الْبَيْعَ لَا يَصِحُّ تَعْلِيقُهُ.
