مطالب أولي النهىal-Ruhaybani

(وَلَا يَصِحُّ تَصَرُّفٌ فِي مَقْبُوضٍ بِعَقْدٍ فَاسِدٍ) ؛ لِأَنَّهُ لَا يَمْلِكُ بِهِ، فَلَا يَنْفُذُ فِيهِ تَصَرُّفٌ (بِغَيْرِ عِتْقٍ) ، فَيَنْفُذُ لِقُوَّتِهِ وَسَرَيَانِهِ وَتَشَوُّقِ الشَّارِعِ إلَيْهِ، وَمَحَلُّ عَدَمِ صِحَّةِ التَّصَرُّفِ فِي مَقْبُوضٍ بِعَقْدٍ فَاسِدٍ إذَا لَمْ يَحْكُمْ بِهِ مَنْ يَرَاهُ، وَإِلَّا نَفَذَ.
