وَيَصِحُّ بَيعُ صُبْرَةٍ بِجِنْسِهَا إنْ عَلِمَا كَيلَهُمَا وتَسَاويهُمَا وَخُلُوَّهُمَا عَنْ مُخَالِفٍ لَهُمَا،

مطالب أولي النهىal-Ruhaybani

(وَيَصِحُّ بَيْعُ صُبْرَةٍ) مِنْ مَكِيلٍ بِصُبْرَةٍ مِنْ (جِنْسِهَا) ، كَصُبْرَةِ تَمْرٍ بِصُبْرَةِ تَمْرٍ (إنْ عَلِمَا كَيْلَهُمَا) ، أَيْ: الصُّبْرَتَيْنِ، وَعَلِمَا (تَسَاوِيَهُمَا وَخُلُوَّهُمَا عَنْ مُخَالِفٍ لَهُمَا) ، لِوُجُودِ الشَّرْطِ وَهُوَ التَّمَاثُلُ،
