مطالب أولي النهىal-Ruhaybani

(وَإِنْ ظَهَرَ) الْغَصْبُ أَوْ الْعَيْبُ مِنْ غَيْرِ الْجِنْسِ (فِي بَعْضِهِ) ، بِأَنْ صَارَفَهُ دِينَارَيْنِ بِعِشْرِينَ دِرْهَمًا، فَوَجَدَ أَحَدَ الدِّينَارَيْنِ مَغْصُوبًا أَوْ مَعِيبًا، (بَطَلَ) الْعَقْدُ (فِيهِ) ، أَيْ: الْمَغْصُوبِ أَوْ الْمَعِيبِ (فَقَطْ) بِمَا يُقَابِلُهُ، وَصَحَّ فِي السَّلِيمِ بِمَا يُقَابِلُهُ.
