وَيَتَمَيَّزُ ثَمَنٌ عَنْ مُثْمَنٍ بِبَاءِ البَدَلِيَّةِ، ولو أَنَّ أَحَدَهُمَا نَقْدٌ، فَمَا دَخَلَت عَلَيهِ فثَمَنٌ،

[فَصْلٌ يَتَمَيَّزُ ثَمَنٌ عَنْ مُثَمَّنٍ بِبَاءِ الْبَدَلِيَّةِ] (فَصْلٌ وَيَتَمَيَّزُ ثَمَنٌ عَنْ مُثَمَّنٍ بِبَاءِ الْبَدَلِيَّةِ، وَلَوْ أَنَّ أَحَدَهُمَا) ، أَيْ: الْعِوَضَيْنِ

(نَقْدٌ، فَمَا دَخَلَتْ عَلَيْهِ) الْبَاءُ، فَهُوَ (ثَمَنٌ) ، فَدِينَارٌ بِثَوْبٍ، الثَّمَنُ الثَّوْبُ، لِدُخُولِ الْبَاءِ عَلَيْهِ
