(وَيَصِحُّ تَصَرُّفُهُ) ، أَيْ: مَنْ صَارَتْ إلَيْهِ (فِيهَا قَبْلَ قَبْضٍ، وَ) إنْ تَلِفَتْ، أَوْ تَغَيَّبَتْ، فَهِيَ (مِنْ ضَمَانِهِ) ، كَسَائِرِ أَمْلَاكِهِ. قَالَ
