وَيَتَّجِهُ: دُخُولُ عُلُوِّ بَيتٍ بِيعَ لَا مَا فَوْقَهُ مِنْ مَسْكَنٍ مُسْتَقِلٍّ.

مطالب أولي النهىal-Ruhaybani

(وَيَتَّجِهُ دُخُولُ عُلُوِّ بَيْتٍ) وَهُوَ مَا فَوْقَ سَقْفِهِ الْمَشْهُورِ بِالْهَوَاءِ (بِيعَ) ذَلِكَ الْبَيْتُ؛ لِأَنَّ الْهَوَاءَ تَابِعٌ لِلْقَرَارِ، وَ (لَا) يَدْخُلُ (مَا فَوْقَهُ) ، أَيْ: الْمَبِيعِ (مِنْ مَسْكَنٍ مُسْتَقِلٍّ) إلَّا أَنْ يَنُصَّ عَلَيْهِ. وَهُوَ مُتَّجِهٌ.
