(وَكَذَا مُشْتَرٍ نَخْلًا) عَلَيْهَا طَلْعٌ (ظَنَّ) الْمُشْتَرِي (طَلْعَهَا لَمْ يَتَشَقَّقْ) ، فَيَدْخُلُ فِي الْمَبِيعِ (فَبَانَ مُتَشَقِّقًا) ، فَيَثْبُتُ لَهُ الْخِيَارُ، وَيَسْقُطُ إنْ وَهَبَهُ بَائِعٌ الطَّلْعَ،
