وَلَا يَغْرِسُ مَكَانَهُ لَوْ بَادَ، لِعَدَمِ مِلْكِهِ الأَرْضَ تَبَعًا لِلشَّجَرِ، وَلَهُ الدُّخُولُ لِمَصلَحَةٍ.

(وَلَهُ) ، أَيْ: لِآخِذٍ (الدُّخُولُ لِمَصَالِحِهِ) ، أَيْ، مَصَالِحِ أَشْجَارِهِ، لِثُبُوتِ حَقِّ الِاجْتِيَازِ لَهُ، وَلَا يَدْخُلُ لِتَفَرُّجٍ وَنَحْوِهِ.
