(وَيَتَّجِهُ) لَا يَلْزَمُهُ جَذُّهُ فِي الْحَالِ (إلَّا مَعَ شَرْطِ قَطْعٍ) ،

فَإِنْ شَرَطَ عَلَيْهِ الْبَائِعُ أَخْذَهُ فِي الْحَالِ، وَكَانَ ذَلِكَ (لِغَرَضٍ) صَحِيحٍ، أَجَابَهُ الْمُشْتَرِي إلَيْهِ، عَمَلًا بِالشَّرْطِ، لِلْخَبَرِ وَهُوَ مُتَّجِهٌ.
