مطالب أولي النهىal-Ruhaybani

(وَإِنْ يُعَبْ) ثَمَرٌ (بِهَا) ، أَيْ: الْجَائِحَةِ، قَبْلَ أَوَانِ جِذَاذِهِ، (خُيِّرَ) مُشْتَرٍ (بَيْنَ إمْضَاءِ) بَيْعٍ (وَ) أَخْذِ (أَرْشٍ، أَوْ رَدِّ) مَبِيعٍ، (وَأَخْذِ ثَمَنٍ كَامِلًا) ؛ لِأَنَّ مَا ضُمِنَ تَلَفُهُ بِسَبَبٍ فِي وَقْتٍ كَانَ ضَمَانُ تَعَيُّبِهِ فِيهِ بِذَلِكَ مِنْ بَابٍ أَوْلَى.
