وَفِي أَثمَانٍ وَيَكُونُ رَأسُ الْمَالِ غَيرَهَا

مطالب أولي النهىal-Ruhaybani

(وَ) يَصِحُّ السَّلَمُ (فِي أَثْمَانٍ) خَالِصَةٍ؛ لِأَنَّهَا تَثْبُتُ فِي الذِّمَّةِ ثَمَنًا، فَتَثْبُتُ سَلَمًا؛ كَعُرُوضٍ، (وَيَكُونُ رَأْسُ الْمَالِ غَيْرَهَا) ؛ أَيْ: الْأَثْمَانِ؛ كَثَوْبٍ وَفَرَسٍ؛ لِئَلَّا يُفْضِيَ إلَى رِبَا النَّسِيئَةِ.
